Neutral Citation No. - 2025:AHC:22678-DB Court No. - 29 Case :- WRIT - C No. - 1982 of 2025 Petitioner :- Abhay Singh Respondent :- State of U.P. and Another Counsel for Petitioner :- Mani Shanker Pandey Counsel for Respondent :- C.S.C.,Gyan Prakash Shrivastava Hon'ble Ashwani Kumar Mishra,J. Hon'ble Vipin Chandra Dixit,J. Petitioner had availed loan from respondent no.2-bank. The bank issued a demand notice for refund of the loan amount. Since such amount was not available in the petitioner's account at Baroda Uttar Pradesh Gramin Bank, the petitioner remitted the due amount from his HDFC bank account. This transfer was made by Phonepe app. It appears that in the mentioning of the account number, while transferring the amount, through Phonepe, one of the digits got wrongly filled and the amount has thus been credited to a different account maintained in the same bank. This account is of the State Government. Petitioner has made an application to the respondent-bank to adjust the amount by debiting the account wrongly credited and credit this amount in the petitioner's account. Sri G.P. Srivastava, learned counsel appearing for the respondent- bank submits that such request can be considered only if a letter/requisition is received from the HDFC bank. This is so because the transfer has been made from HDFC bank. In that view of the matter, we permit the petitioner to represent the HDFC bank with the request to credit the amount in petitioner's correct account. The HDFC bank upon such approach made shall forward necessary request letter to respondent no.2-bank, to process the petitioner's claim, in accordance with law, within a period of two weeks. Based upon such request the respondent no.2-bank shall do the needful, as per law, in the above facts, within four weeks. With the above observation/direction, the writ petition stands disposed of.
