(Oral) As observed in the previous order, despite service, the respondent did not make appearance, on that date. Even today, he has not made appearance. As such, respondent is proceeded against ex parte. Counsel for the applicant heard. The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. DMC- 65-2025, titled ‘Harjeet Singh v/s Kiran Bala’, filed by the respondent- husband, pending in the Family Court, Talwandi Sabo, District Bathinda and she seeks transfer of the same to the Court of competent jurisdiction at Jalandhar. At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place in the year 2017. One daughter, aged about 7 years, born from the estranged marriage, is in the care and custody of the applicant. On query by the court, it is stated that the applicant is not working and as such, has no source of earning. The distance between the two places is stated to be about 190 kms. On query, it is also submitted that apart from the petition under Section 9 of Hindu Marriage Act, there is no other litigation pending between the parties. In view of the submissions aforesaid, more particulary, considering the fact of the female child, born from the estranged marriage, to be in the care and custody of applicant, who herself is having no source of earning and above it, the fact of respondent having not come forward to resist the transfer application, the same is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. DMC-65-2025, titled ‘Harjeet Singh v/s Kiran Bala’, filed by the respondent-husband, stands transferred from the Family Court, Talwandi Sabo, District Bathinda to Family Court, Jalandhar. The requisite record of the aforesaid case be sent by the Family Court, Talwandi Sabo, to District and Sessions Judge, Jalandhar. Learned District and Sessions Judge, Jalandhar, shall assign the said petition to the Family Court, Jalandhar. Even, the parties are directed to appear before the Family Court, Jalandhar, within a period of one month from today onwards.
