Heard learned counsel for the petitioner, Mr. Hare Ram, learned Standing Counsel for the State-respondent, Mr. Vipin Bihari Pandey, learned counsel for the respondent nos.3 to 5 and perused the record. The petitioner has preferred instant writ petition for a direction upon respondents to pay the salary to the petitioners to the post of Head master of Composite Schools/Primary School with all consequential benefits as they are performing the duty as Head Masters, withing stipulated period and a further prayer to direct the respondent no.4 to decide the representation of the petitioners dated 19.05.2025 with speaking and reasoned order within stipulated period. Learned counsel for the petitioner submits that the petitioners, who are 44 in number, have approached the authority concerned by moving representations for ventilation of their grievances,. However, despite several representations moved by the petitioners, no heed has yet been paid. Learned counsel for the State-respondents submits that the controversy regarding payment of the aforesaid has been settled by the Division Bench of this Court in Special Appeal No.652 of 2024 (Secretary, U.P. Basic Education Board and 2 others vs. Tripurari Dubey and 3 Others), decided on 30.04.2025. However, in case fresh representations are moved by the petitioners individually before the authorities concerned for redressal of their grievance, the same shall be considered in accordance with law. Considering the facts and circumstances of the case but without expressing any opinion on the merits of the case set up on behalf of the petitioner, the present writ petition is disposed of by providing that the petitioners may make fresh applications/representations, individually, ventilating all their grievances, supported by such documents, as may be advised, before the respondent no.3; Secretary, U.P.
