THIS CRIMINAL PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
ORAL ORDER (PER: THE HON'BLE MR. JUSTICE S.RACHAIAH)
1. The learned counsels for the respective parties have filed application under Section 320(2) r/w. Section 482 of Cr.P.C/ under Section 359(2) r/w. Section 528 of BNSS,
2023. 2. The averments of the said application are as follows;
“2. It is respectfully submitted that during the pendency of the above Criminal Petition, the Petitioner and Respondent No.2 have resolved the dispute between themselves amicably with the intervention and guidance of elders, well-wishers, and responsible persons. Respondent No.2, upon proper reflection and clarification of facts, has realized that the complaint was lodged under a mistaken impression and that the incident did not occur in the manner initially apprehended
3. It is further submitted that Respondent No.2 has voluntarily agreed to compound the offence alleged against the Petitioner.
The present compromise has been arrived at consciously and voluntarily, out of free will, without any force, pressure, coercion, threat, or undue influence from any quarter, and the same is genuine and bona fide. - 3 -

4. It is submitted that as on date, Respondent No.2 has no grievance whatsoever against the Petitioner and does not wish to pursue the criminal proceedings any further. The parties have decided to maintain peace and harmony and to live cordially, without allowing the present dispute to disturb social harmony or family life. 5. It is respectfully submitted that in view of the compromise arrived at between the Petitioner and Respondent No.2, the continuation of criminal proceedings in S.C. No. 80/2025 arising out of Crime No. 136/2025 of Sub-Urban Police Station, Dharwad would serve no useful purpose and would only result in unnecessary hardship, mental agony, and multiplicity of proceedings. 6. It is submitted that the offence alleged is personal in nature and does not have any serious impact on society at large. In view of the compromise between the parties and the settled principles of law governing such matters, this Hon'ble Court may be pleased to accept the present compromise and pass appropriate orders in the interest of justice and equity.”
3. On considering the said averments of the application, there is no embargo on this Court to record the compromise. 4. Accordingly, I proceed to pass the following:

ORDER. i) The petition is allowed in terms of the compromise. ii) The entire proceedings in SC No.80/2025 pending on the file of Ii-Additional District and Sessions Judge, Dharwad, arising out of Crime No.136/2025 of respondent/Police, is hereby quashed. iii) In view of the disposal of the main petition, pending I.As, if any, are disposed off.
