HON'BLE MR. JUSTICE NARENDRA SINGH DHADDHA
Order 15/01/2025 By way of this petition, the petitioner-defendant (for short 'the defendant') has challenged the order dated 24.05.2014 passed by Additional District and Sessions Judge No.5 Kota in Temporary Injunction Application No.19/2014 whereby the defendant has been restrained to raise any construction over the plot in dispute without obtaining permission of the Municipal Corporation, Kota and to maintain status quo as on that date over the property in question. He has prayed that the order dated 24.05.2014 passed by the appellate court be set aside and the
order dated 06.05.2014 passed by the trial court in civil suit No.118/2014 dismissing the Temporary Injunction Application No.113/2014 filed by the respondent-plaintiff (for short 'the plaintiff') be restored.
[2025:RJ-JP:1993] (2 of 2) [CW-6448/2014] Taking into consideration the facts and circumstances of the case and more particularly in view of the fact that the suit was instituted before the trial Court in the year 2014 and more than 10 years have been passed therefrom, instead of interfering with the impugned orders, I dispose of the present writ petition with direction to the trial Court to decide the suit, if pending before it, expeditiously, in accordance with law. Pending application(s), if any, stand(s), disposed of. Registry is directed to send a copy of this order to the concerned trial Court for information and compliance.
