1. The appeal is restricted to the final order passed by learned Single Judge where learned Single Judge has, while allowing the writ petition, held the petitioner to be entitled to all service benefits at par with other candidates who were appointed, alongwith arrears of salary for the intervening period.
2.
Learned counsel for the appellants submits that withholding of appointment of respondent No.1 was on certain grounds which have been held to be not acceptable by the learned Single Judge. In the circumstances, there was no occasion to give actual arrears of salary for the intervening period when respondent No.1 had not been appointed.
3.
Learned counsel for respondent No.1 submits that once respondent No.1 has been denied appointment and the Court has reached to the conclusion that the denial was wrongful then respondent No.1 deserves to be given actual benefits.
4. We have considered the submissions.
5. The ground for denial of appointment was that resondent No.1 had not signed the application form in terms of the conditions laid down in the advertisement. The objection was with regard to the signature of respondent No.1 which were mentioned in capital as well as small letters. Learned Single Judge has found the said action to be unjustified. The petitioner would be entitled for his seniority as per his merit.
