Heard the learned counsel for the petitioner and the learned Assistant Government Pleader appearing for respondents 1 to 4. 2. The learned counsel for the petitioner submits that this writ petition has been filed to challenge the inaction of the 4th respondent in registering a crime based on the complaint of the petitioner dated 28.01.2025. 3. Today, when the matter is taken up for hearing, the learned Assistant Government Pleader for Home, on written instructions, submits that based on the complaint of the 5th respondent herein, the station house officer, Proddatur II Town U/G police station, registered a case in crime -2- No.317 of 2024 against the petitioner. Now the petitioner has filed a counter-complaint, which is entered in the station general diary. 4. Considering the same, this Court deems it appropriate to dispose off the writ petition, directing the 3rd respondent to conduct preliminary enquiry as contemplated under section 173(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, insofar as the complaint of the petitioner is concerned. 5. Accordingly, the writ petition is disposed off. No costs. 6. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ____________________ JUSTICE HARINATH.N BV
