Tiwari, learned counsel for the petitioner, learned Standing Counsel for respondent Nos.1 to 5 & Sri H.N. Singh, learned counsel for respondent No.6. 2. It is argued by learned counsel for the petitioner that vide order dated 18.09.2023 passed by respondent No.4/Sub Divisional Magistrate, Tehsil Maitha Kanpur Dehat by which permission was granted to the respondent No.7/Smt. Shailja to run the fair price shop. It is argued that respondent No.7 is not entitled to appoint as fair prince shop dealer. On the said complaint, a report dated 12.06.2025 was submitted by the respondent No.4/Sub Divisional Magistrate, Tehsil Maitha Kanpur Dehat before the respondent No.2, copy of the same is appended as Annexure No.2 to the writ petition. It is argued that considerable time has already been lapsed but till date no final decision has been taken in the matter. 3. On the other hand, it is argued by learned Standing Counsel that the respondent No.2 will take a decision in the matter expeditiously. 4. Heard learned counsel for the parties present and perused the record. 5. In view of the order proposed to be passed herein, no useful purpose would be served by putting the private respondent to notice and keeping this petition pending before this Court. However, in case the private respondent feels aggrieved by the order his/her right to seek modification/variation of the order is being kept reserved. 6. In the facts and circumstance of the case, the present petition is disposed of directing the respondent No.2/District Magistrate, Kanpur Dehat to take a decision in the matter most expeditiously and preferably within a period of three month from the date of production of certified copy of this order.
