Neutral Citation No. - 2025:AHC:137968 Court No. - 36 Case :- WRIT - C No. - 27295 of 2025 Petitioner :- Kuldeep Kumar And 6 Others Respondent :- State Of Up And 3 Others Counsel for Petitioner :- Dheeraj Kumar Dwivedi Counsel for Respondent :- C.S.C.,Hari Narayan Singh Hon'ble Dr. Yogendra Kumar Srivastava,J. Heard Sri D K Dwivedi, learned counsel for the petitioners and Sri Anand Bhaskar Srivastava, learned Standing Counsel appearing for the State-respondents. The present petition has been filed, seeking a direction to respondent No. 2, the Additional City Magistrate-III, District Kanpur Nagar, to decide the Case No.16894 of 2019 (Computerized Case No. T201903410116894) [Susheel Kumar vs. Kailash Nath Dixit and others) under Section 144 of the U.P. Revenue Code 2006, expeditiously and within a stipulated period. The petitioners have stated themselves to be the defendants in the pending suit.
Learned counsel for the petitioners has referred to the order sheet of the case, a copy whereof has been appended to the writ petition, to point out that although several dates have been fixed but for some reason or the other, the matter has been adjourned and the delay in disposal of the case is causing undue hardship to the petitioners. Attention of the Court has been drawn to paragraph 458 of the U P Revenue Court Manual, wherein it is provided that the Court shall endeavour to finally decide a suit within a period of one year from the date of its institution.
Accordingly, a prayer is made for a direction to the court/authority concerned to conclude the proceedings expeditiously and at an early date.
Learned counsel for the State-Respondents has no objection to the prayer made. Having regard to the aforesaid, the present petition is disposed of with an observation that the court/authority concerned would make an endeavor to conclude the proceedings of the case, which is stated to be pending before it, preferably within a period of one year without granting any unnecessary adjournments to either of the parties, provided there is no other legal impediment.
