This Civil Revision Petition has been filed by the petitioner/defendant under Article 227 of the Constitution of India, challenging the delay in disposing of I.A.No.397 of 2022 in O.S.No.53 of 2022, pending before the VIII Additional District Judge, Vijayawada, Krishna District. 2 (RNT,J C.R.P.No.540 of 2025) 3. The respondent/plaintiff filed O.S.No.53 of 2022 on the file of the VIII Additional District Judge, Vijayawada, Krishna District, seeking cancellation of sale deed. Along with the suit, the plaintiff filed I.A.No.397 of 2022 under Order 39 Rule 3(2) of the Code of Civil Procedure,1908 (in short ‘CPC’). The learned Court granted ad interim ex parte injunction on 02.05.2022 and the same is being continued from time to time. 4. The learned counsel for the petitioner submits that I.A.No.397 of 2022 is still pending and has not been disposed of even after more than two years. Aggrieved by this inaction, the present Civil Revision Petition has been filed. He further submits that the petitioner is not pressing the other prayer, and requests that the present petition be disposed of with a direction to the learned Court to expeditiously dispose of I.A.No.397 of 2022. 5. Considering the submissions advanced by the learned counsel for the petitioner, to meet the ends of justice, however, without observing anything on the merits of claim made either in the application or the case set up by the petitioner in the counter-affidavit, this Civil Revision Petition is being disposed of at the stage of admission itself, with a direction to the learned VIII Additional District Judge, Vijayawada, Krishna District, to dispose of I.A.No.397 of 2022, after giving due opportunity of hearing to the parties in accordance with law, as expeditiously as possible, preferably, within a period of three months (03) from the date of receipt of a copy of this order, if there is no other legal impediment. 3 (RNT,J C.R.P.No.540 of 2025) No order as to costs.
