JUDGMENT
1. The present contempt petition has been filed alleging non- compliance/willful disobedience of the Judgment dated 03.08.2023 passed in W.P.(C) No. 9622 of 2023. 2. This Court, while disposing of the said writ petition, directed the competent authority of the 1st respondent to ensure that all eligible retiral benefits are disbursed to the petitioner either in lumpsum or in installments as expeditiously as possible, but not later than ten months from the date of receipt of a copy of the Judgment. It is further said that after the payment as directed is made by the respondents, the petitioner would be at liberty to invoke any remedy, if she intended to claim interest on the same. 3.
The learned Standing Counsel for the respondent/contemnor submits that in response to the contempt notice issued in the current contempt petition, an affidavit of compliance has been filed and as per the said affidavit, the gratuity amount of Rs. 11,45,648/-, Covid 19 relief fund recovery of Rs. 70,820/- and terminal surrender of Rs. 4 W.P.(C) No. 1767 of 2024

4,64,404/-, total sum of Rs. 16,80,872/- has been paid to the petitioner. It is, therefore, submits that the aforesaid Judgment has been complied with. 4. The learned Counsel for the petitioner does not dispute that the petitioner has received the said amount of Rs. 16,80,872/-. However, he submits that the full amount has not been paid. 5. I do not find the contention raised by the learned Counsel for the petitioner as tenable. The respondents were directed to pay the full eligible amount to the petitioner which has been paid. However, if the petitioner wants to raise a dispute regarding the sum paid to her, the remedy is not contempt petition but somewhere else for which she may take recourse to the appropriate remedy. With the aforesaid observations, the present contempt petition is hereby closed. Sd/-
