Learned AG&OT would submit that the present applications are not maintainable. The learned AG&OT would submit that public auction was conducted in respect of the subject property and the 2nd respondent was the successful bidder. An agreement was entered into between AG&OT and the 2nd respondent on 24.06.2025, but the 2nd respondent was chronic defaulter in payment of monthly rent. He has paid the monthly rent for one month and continuously committed default in payment of rent for 11 months. 3. In view of the default in payment of monthly rent, AG&OT issued several notices to the 2nd respondent and subsequently, this Court passed an order directing AG&OT to continue all further action to ensure that the lease agreement is cancelled and possession is taken back. AG&OT is in the process of continuing all further course of action. 4. In view of the above fact, the present application filed seeking a direction to recall the order dated 09.06.2025, confirming the public action in favour of the 2nd respondent, does not arise at all, since the 2nd respondent is a defaulter in payment of rent and further actions are initiated by AG&OT to cancel the agreement and to evict the 2nd respondent from the subject premises. https://www.mhc.tn.gov.in/judis A No. 3364 of 2025 __________ Page4 of 5 5. This being the position, no further relief needs to be granted in both the applications.
