Learned counsel for the respondent submits that although the petitioner has filed an application subsequently after disposal of the suit and the said application having been rejected, the present writ petition is filed, nevertheless, the petitioner herein had disposed of the suit schedule property to a third party and the same was questioned in another proceedings and the objections raised by the respondent herein has been upheld and the proceedings have been initiated against the petitioner.
