The petitioner is before this Court calling in question appointment of the respondent No.8 as Anganvadi helper in the Baichavalli Village of Hangal Taluk. 2. Heard the learned concerned Smt. Padmaja Tadapatri appearing for the petitioner, learned AGA Smt. Girija S. Hiremath for respondent Nos.1 to 7 and the learned counsel Sri. Vishwanath Bichagatti for respondent No.8. 3. The facts in brief germane are as follows. A notification comes to be issued by the State seeking appointment of Anganvadi worker and helper to the aforesaid Anganvadi Center. A committee comes to be constituted for the purpose of selection on 11.08.2020. The petitioner and the respondent No.8 both apply pursuant to the said notification. On 13.11.2020, the committee after assessment of the documents notifies a provisional select list and then a final select list despite the objections of the petitioner. The final select list selects the respondent No.8 as Anganvadi helper in the aforesaid Anganvadi

Center. The petitioner challenges the same before this Court in the subject petition. 4. The learned counsel appearing for the petitioner submits that the petitioner is qualified to hold the post. The respondent No.8 is over qualified to hold the post as the respondent No.8 is a graduate – Bachelor of Arts. The learned counsel would further contend that the respondent No.8 has suppressed the fact that she is a graduate but has produced only the marks card of 9th standard to secure the appointment and would further submit that the Anganvadi Center is not situated where she resides as she gives the address of her parents as staying there notwithstanding the fact that she is married. 5.
The learned counsel appearing for the respondent No.8 would seek to defend the action on the score that over qualification is no bar to secure appointment as Anganvadi helper and would submit that the petitioner is residing with her parents and therefore, the said address has been rendered. 6. The learned AGA would toe the lines of the learned counsel appearing to the respondent No.8 in contending that the

respondent No.8 is appointed 4 years ago and the said appointment should not be disturbed at this juncture. 7. I have given my anxious consideration to the
submissions of the learned counsel for parties and have perused the material on record. 8. The afore-narrated facts are not in dispute. The issue lies in a narrow compass. The qualification in terms of the notification for appointment of Anganvadi helper, the qualification is as follows. CfðAiÉÆA¢UÉ ®UÀwÛ¸À¨ÉÃPÁzÀ zÁR¯ÉUÀ¼ÀÄ:-

2) d£À£À ¥ÀæªÀiÁt ¥ÀvÀæ/ d£Àä ¢£ÁAPÀ EgÀĪÀ J¸ï.J¸ï.J¯ï.¹. CAPÀ¥ÀlÖ

8) DvÀäºÀvÉå ªÀiÁrPÉÆAqÀ gÉÊvÀgÀ ¥Àwß JAzÀÄ G¥À «¨sÁUÁ¢üPÁjUÀ½AzÀ ¥ÀqÉzÀ ¥ÀæªÀiÁt ¥ÀvÀæ,
9. An Anganvadi worker must have 10th standard and Anganvadi helper should have passed 9th standard. This is the qualification necessary for consideration of the cases per worker or helper. As observed, the petitioner and the respondent No.8 apply for the post of Anganvadi helper. The respondent No.8 is selected on the score that the eighth respondent's marks in the 9th standard was over and above the marks of the petitioner, but the fact remains that the respondent No.8 has played fraud upon the State by producing a 9th standard marks card notwithstanding the fact that she is a graduate. The evidence of the respondent No.8 being a graduate is as follows:

10. It is a certificate issued of the petitioner passing B.A. in the college as on 15.03.2021. In that light, whether the

petitioner belongs to the said village or otherwise need not be gone into, as the petitioner suppresses the fact that she is overqualified to the post, produces a 9th standard marks card and secures the employment. If this cannot be termed as playing fraud on the State, nothing else can be. 11.
In that light, the appointment of the respondent No.8 must necessarily be obliterated. The petition thus deserves to succeed on this sole score. For the aforesaid reason, the following:
ORDER i. Writ Petition is allowed. ii. The impugned order dated 16.02.2021 issued by the respondent No.3 stands quashed. iii. The appointment of the respondent No.8 stands obliterated. The appointment shall be offered to the petitioner, if the petitioner is found eligible in all other facts.
