The petitioner is before this Court seeking the following prayer: I) Mandamus directing the Respondents to consider the legal notice issued on behalf the petitioners dated 26.10.2016 and 02.06.2014 vide Annexure-G and H as their personal representation and direct the respondent to take necessary action. II) Grant such other relief as this Hon’ble Court may deem fit in the circumstances of the case. Heard the learned counsel Sri.Jagadish Patil along with Sri.Vyas Desai, appearing for petitioner and learned HCGP-Smt.Girija Hiremath, appearing for respondent No.1 and learned counsel Sri.Anoop G. Deshpande, appearing for respondent Nos.2 and 4. 3. The petitioners are all persons, who were appointed on contract basis through outsource agencies during the year 2012-2013. The subject petition is preferred on the score that the petitioners are entitled to be considered for regularisation in their services as on the date of submission of the application which was in the year 2016. That having not been considered, the subject petition has sprung. 4. The learned counsel for the petitioners submits that even as on today the petitioners are working and therefore have now rendered more than 15 years of service, albeit through an outsource agency. The representation has not yet been considered. Though what is sought for is consideration of legal notice, which cannot be in law. - 7 - HC-KAR NC: 2025:KHC-D:17094 WP No. 111658 of 2017 5. Therefore, I deem it appropriate to direct the respondents to treat the same as a representation and consider the same, and pass necessary orders in accordance with law, if not already replied to as of today, within 12 weeks from the date of receipt of the copy of this order. 6. In the event the legal notice has stood replied, the petitioners are at liberty to avail of such remedy as is available in law. Ordered accordingly.
