Neutral Citation No. - 2025:AHC:10618-DB Court No. - 29 Case :- WRIT - C No. - 29261 of 2024 Petitioner :- Ganpati Jha Respondent :- State Of Up And 4 Others Counsel for Petitioner :- Ashutosh Ganguli,Pranab Kumar Ganguli Counsel for Respondent :- C.S.C.,Vineet Sankalp Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Heard learned counsel for the petitioner and Sri Vineet Sankalp, learned counsel for respondent nos.4 and 5 The petitioner claims to be Archak in 'Shri Kashi Vishwanath Temple at Varanasi'. He has approached this Court for issuance of a directions to allow him to perform his duties till he attains the age of 65 years. Admittedly, the management of 'Shri Kashi Vishwanath Temple at Varanasi' is regulated by provisions of U.P. Act No.29 of 1983 known as 'Shri Kashi Vishwanath Temple' Adhiniyam 1983. The service condition of Archak was proposed to be regulated by Regulation of 2023 but Regulations have been disapproved by the State Government. The management of the Temple is regulated by the Board of Trustees which has already passed a resolution in its meeting on 21.05.2022 not to extend the age of Archak beyond 60 years. This resolution of the the Board of Trustees is not under challenge. Once that be so, no mandamus can be issued to allow the petitioner to continue as Archak beyond 60 years of age. Admittedly, the petitioner has otherwise attained maximum age of 60 years. Consequently, the instant writ petition is dismissed.
