1. This criminal petition is filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [for short ‘B.N.S.S.’] seeking to quash the proceedings in C.C. No.670 of 2024 on the file of Additional Judicial Magistrate of First Class, Amalapuram.
2. The learned counsel for the petitioner submits that the petitioner was arraigned as A.2 in C.C. No.670 of 2024. It
-2- CRL.P. No.2064 of 2025 is further submitted that the 2nd respondent has filed a complaint against the petitioner and another. It is submitted that the petitioner only issued notice to the 2nd respondent on instructions of the superior officers and that the de facto complainant bore a grudge against the petitioner and implicated him in a false case.
3. Considering the nature of the case, this Court, without going into the merits of the case, deems it appropriate to dispense with the presence of the petitioner/ A.2 in C.C. No.670 of 2024 pending on the file of Additional Judicial Magistrate of First Class, Amalapuram, subject to the petitioner filing an affidavit undertaking that he shall appear before the Additional Judicial Magistrate of First Class, Amalapuram, as and when required.
4. With these observations, the criminal petition is disposed off.
