Applicant is in judicial custody in FIR No.264 of 2023, under Sections 29 read with Section 22/8 of the Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Gadarpur, District Udham Singh Nagar. He has sought his release on bail.

Heard learned counsel for the parties and perused.

According to the FIR, narcotic substance, in commercial quantity, was recovered from the possession of co-accused Javed Alam. It was revealed that, in fact, applicant was also in the business of supplying narcotic substance. Co-accused Javed Alam and the applicant have called each other multiple times on the date of incident.

It is argued by learned counsel for the applicant that co-accused, Javed Alam, has already been granted bail; nothing was recovered from the possession of the applicant.

Learned State Counsel admits these facts.

Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.
8.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
