With the consent of both sides, this Writ Petition is taken up for final disposal. 3. The relief sought in this Writ Petition is to direct the 1st Respondent to refer the matter to Court for determination of proper compensation in respect of Petitioners’ land measuring an extent of 296 Sq.mtr comprised in Survey No.263/9 situated at Peerkankaranai Village, Tambaram Taluk, Chengalpattu District (hereinafter referred to as “subject property”) on the basis of the Petitioners’ Petition dated 09.04.2023, by fixing a time limit. https://www.mhc.tn.gov.in/judis W.P.No.31189 of 2025 __________ Page3 of 5 4. The case of the Petitioners is that the subject property was acquired for Railway Over Bridge between Tambaram and Vandalur under the Tamil Nadu Highways Act, 2001 (Tamil Nadu Act 34 of 2001) read with Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Upon completion of acquisition process, an award was passed in Award No.1 of 2022 dated 22.09.2022, fixing the compensation for the acquired subject property at Rs.3,51,07,912/-. The said compensation amount has also been credited into the 1st Petitioner’s Bank Account on 31.01.2023. While so, Petitioners submitted the Petitions dated 09.04.2023 & 23.05.2023 before the 1st Respondent, requesting to refer the matter to Court for determination of proper compensation. That apart, Petitioners have sent a Legal Notice dated 13.04.2024 to the 1st Respondent, upon receipt of which, 1st Respondent vide Communication dated 23.04.2024 bearing Na.Ka.630/2022 (A4), forwarded the said Legal Notice to 3rd Respondent, directing to refer the matter to Court. However, till date, the matter has not been referred to Court. Hence, Petitioners have filed the present Writ Petition for the relief stated supra. 5. Heard the learned counsel on either side and perused the materials available on record. 6. Considering the limited relief sought by the Petitioners, this Court, without going into the merits of the case, directs the 1st Respondent to refer the https://www.mhc.tn.gov.in/judis W.P.No.31189 of 2025 __________ Page4 of 5 matter to the Principal District Court, Chengalpattu, within a period of six weeks from the date of receipt of a certified copy of this order. On such reference by the 1st Respondent, the learned Principal District Judge, Chengalpattu shall consider the Petitioners’ request for enhancement of compensation awarded for the acquired subject property and pass appropriate orders on merits and in accordance with law, as expeditiously as possible, after issuing a notice affording an opportunity of personal hearing to the Petitioner. 7. This Writ Petition is disposed of with the above directions.
