The petitioner, Deputy Executive Engineer (R& B), APRDC, Eluru Sub- Division, filed the above writ petition to declare the action of the respondents in not considering the petitioner’s candidature for promotion due to pendency of charge memo vide G.O.Rt.No.220 Water Resources (Vigilance-1) Department, date4d 02.05.2024 (Ex.P.1) was issued to the petitioner. The petitioner submitted an explanation / written defence vide Letter No.Vigilance/3/4/DEE/2024, dated 01.07.2024 (Ex.P.2). The Government also 2. 2 M' issued G.O.Rt.No.206 Water Resources (Vig.l) Dept., dated 02.05.2024 initiating common disciplinary action against the petitioner and other co charged officers. Learned counsel for the petitioner would submit that due to the pendency of the aforementioned charge memo, the respondents have not considered the petitioner’s candidature for promotion though the petitioner is eligible for promotion. 3. 4. At the hearing, learned counsel for the petitioner confined his arguments and urged to direct the respondents to consider the case of the petitioner for promotion, in terms of G.O.Ms.No.257 General Administration (Ser.C) Department, dated 10.06.1999. Learned Assistant Government Pleader for Services did not refute the said submission. 5. Given the facts and circumstances of the case, without touching the merits of the matter, the Writ Petition is disposed of, at the admission stage, with the consent of learned counsel on either side directing respondents to consider the petitioner’s case for promotion to the post of Executive Engineer in R&B Department, if her case is in the zone of consideration, strictly in terms of G.O.Ms.No.257, dated 10.06.1999 whenever DPC is constituted.
