Neutral Citation No. - 2025:AHC:135549-DB Court No. - 40 Case :- WRIT - C No. - 26823 of 2025 Petitioner :- Deepak Electricals Respondent :- State Of Uttar Pradesh And 6 Others Counsel for Petitioner :- Sanjay Kumar Mishra,Saurav Pandey Counsel for Respondent :- C.S.C.,Sanjay Kumar Om Hon'ble Saral Srivastava,J. Hon'ble Arun Kumar Singh Deshwal,J. 1. Heard learned counsel for the petitioner; Sri Sanjay Kr. Om, learned counsel for the respondents No. 2 to 4; and Standing Counsel for the State. 2. By means of the present petition, the petitioner has prayed for the following relief:- "1. Issue a writ, order, or direction in the nature of mandamus, thereby commanding the respondent authorities to release the due and lawful payment of Rs.7,97,872/- (Rulees Seven Lakh Ninety-Seven Thousand Eight Hundred Seventy-Two only) to the petitioner under Work Order No. 1209/M-8/19 dated 21.12.2022, along with interest accrued thereon, computed at the rate of 18% per annum, or such higher sum as may be found due and payable". 3. Sri Sanjay Kr. Om, learned counsel for the respondents, has filed instructions which are taken on record. He submits that the amount due is not in dispute and the payment of the petitioner shall be released within three months from today. 4. On the aforesaid submission, learned counsel for the petitioner submits that since the delay in releasing the payment is on the part of the respondent, therefore, the petitioner is entitled to interest on the aforesaid amount. 5. Considering the aforesaid submission, we are of the opinion that since the payment of the petitioner is not disputed by the respondent, we direct the respondent to release the payment of the petitioner within a period of two months from today. 6. Since the work was completed by the petitioner on 21.12.2023 and more than one and a half years have passed and the petitioner's amount due has not been released by the respondent, we find that the submission of the counsel for the petitioner in respect of the award of interest is justified. 7. Considering the fact that the delay in the payment of the amount is an inordinate delay, we direct the respondent No.6 to pay simple interest at the rate of 7% from the date the amount is due to the petitioner till its payment. 8. With the aforesaid direction, the petition is disposed of. Order Date :- 11.8.2025 Vandana (Arun Kumar Singh Deshwal,J) (Saral Srivastava,J.)
