Through the medium of the instant petition filed under the provisions of Article 226 of the Constitution of India, petitioner has sought the issuance of a Writ of Mandamus for directing/commanding the respondents to issue passport in his favour. 2. The case of the petitioner in nutshell is that he applied for issuance of passport in his favour on 09.09.2024, however, since then the same has not been issued in his favour. That he came to know about the online status of his application form as, “Police verification report is not clear and application is under review at Regional Passport Office,”. He apprehends that his passport is not issued probably due to registration of case against him. That, however, the said case stands already disposed of with his acquittal. 3. Heard the learned counsel for the petitioner in respect of the admissibility of the petition. Also heard Mr. T.M. Shamsi, ld. DSGI in rebuttal. Considered their rival submissions. 4. In the facts and circumstances of the case, this Court is of the opinion that matter can be taken up for final disposal at this threshold stage by passing of such appropriate orders which shall safeguard the rights of both the parties without any prejudice to them. 5. The petitioner has placed on record by way of annexure- 2 a copy of the judgment dated 31.03.2022 passed by the learned Judicial Magistrate (Munsiff Chadoora) in case ‘State through FIR No. 14/2013 of P/S CIK Srinagar vs. Ali Mohammad Wani’ as per which the accused-petitioner stands acquitted in the said case FIR. 6. Accordingly, the petition is taken up for final disposal and is disposed of with the direction to the respondents to expedite the process on the application of the petitioner, considering his acquittal in the afore-mentioned criminal case. 7.
