ORDE R 19.02.2025
1. The short grievance projected by the petitioner in this petition is that, vide order dated 15th June, 2023, the provisional enrollment of the petitioner as an Advocate/Pleader was struck off from the rolls of the Jammu and Kashmir Bar Council, on the ground that the petitioner had not produced the copy of LLB Degree.
2. The learned counsel appearing on behalf of the petitioner submits that the LLB Degree, which the petitioner had obtained from the Kashmir University, could not be produced at the relevant time before the authorities concerned as the same was gutted in fire. It is submitted that the petitioner applied for duplicate copy of the certificate to the University of Kashmir, which was provided to him only in the year 2024. It is further submitted that the petitioner will comply with all the required formalities, as such, this petition may be disposed with a direction to the J&K Bar Council (High Court) to consider the request of the petitioner for his enrollment.
3. Having heard the learned counsel for the parties and regard being had to the short submission made by the learned counsel for the petitioner, we propose to dispose of this petition by providing as under:
(i) That the petitioner shall move a formal application for his enrollment before the authorities concerned, supported by duplicate LLB Certificate issued by the University of Kashmir, within a period of two weeks from today. The competent authority shall consider the application of the petitioner and pass appropriate orders, provided the petitioner complies with all other requirements. A decision in this regard shall be taken by the High Court within a period of two months from the date all the requisite formalities are completed by the petitioner. Ordered accordingly.
4. Writ petition disposed of along with connected CM(s) on the above terms.
