JUSTICE SUSMITA PHUKAN KHAUND ORDER Date : 04.04.2025 Heard learned counsel Ms. D Ghosh for the petitioners (1) Mafida Khatun @ Mafida Begum, (2) Manjuwara Khatun @ Manjuwara Parbin, (3) Menoka Biswas, (4) Yamuna Das @ Jamuna Nama Das, (5) Saya Biswas @ Sayarani Biswas, (6) Swaraswati Biswas, (7) Arati Barman, (8) Malati Biswas @ Malati Das Biswas, (9) Padma Sarkar Das, (10) Fajila Khatun, (11) Fulen Mandal @ Fulan Mandal, (12) Suchitra Barman Biswas, (13) Renu Barman, (14) Ms. S, (15) Dipika Biswas, (16) Ranu Mandal @ Ranu Biswas, (17) Arati Biswas, (18) Dipika Biswas, (19) Manorama Biswas who have filed this application under Section 482 of the BNSS, Page No.# 5/5 with prayer for pre-arrest bail as they are apprehending arrest in connection Samaguri PS Case No. 47/2025 under Section 189(2)/329(4)/351(2)/108 of BNS, 2023. Heard Mr. D.P Goswami, learned Additional Public Prosecutor, Assam. It is submitted on behalf of the petitioners that the petitioners are not responsible for the suicidal death of minor victim X and another victim Y. The petitioners were granted pre- arrest bail by a co-ordinate Bench of this Court vide order dated 03.03.2025. It is submitted on behalf of the petitioners that they were spreading awareness against child marriage and both the deceased victims were married before X attained majority. It is submitted that the petitioners have not induced the victims to commit suicide and no overt act can be attributed to the petitioners. I have also scrutinized the Case Diary. The petitioners have appeared before the I/O and their statements have been recorded. The petitioners have not violated any bail conditions.
