1. The petitioner has filed the present petition under Section 482 of B.N.S.S with a prayer to grant anticipatory bail to him in case FIR No.139, dated 11.06.2025, under Sections 304,126(2),115(2),61(2),3(5) of B.N.S and Section 117(2) of B.N.S added later on, registered at Police Station Bhawanigarh, District Sangrur, Punjab. (Annexure P-1). 2. The FIR in the present case was registered on the basis of the statement made by Princepal Singh and the same has been reproduced below:- Copy of statement "Statement of Princepal Singh son of Sukhwinder Singh son of Ikbal Singh resident of Bijalpur near Gurudwara Sahib Thidal stand aged about 30 years mobile no. 6239301799, 8847034208. Stated that I am resident of above mentioned address. I am BA passed. Now I am working in Bajaj Finance Limited, Yesterday dated 10.06.2025 I with regard to my swift car no. CRM-M-40433-2025 (O&M) -2 received call from my relative Manpreet Kaur wife of Sahib Singh son of Avtar Singh resident of Shankerpur police station Sadar Patiala that I and my daughter Navdeep Kaur also have to go Faridkot take us alongwith you upto Sangrur. Then I at about 8:30 A.M. on pasiana bypass near over bridge started alongwith Manpreet Kaur and his daughter Navdeep Kaur aged 12 years on my swift car for Sangrur, I near Toll Plaza Munshiwala at about 9:00 Α.Μ.
was installing fast tag and Manpreet Kaur and her daughter Navdeep Kaur were sitting, then from Patiala side one XUV colour white HR number stopped near us from which Bikramjeet Singh, Kaptan Singh son of Angrez Singh resident of Shankerpur and Deep son of not known resident of Mohabatpur holding Danda enligtened, who after danda enligtened, who after been enligtened started abusing me and Manpreet Kaur, when I asked them reason then they said that you took Manpreet Kaur with bad intention and Kaptan Singh video called Sahib Singh son of Avtar Singh resident of Shankerpur infront of us talked with him and said to teach me lesson beat him improper manner, By listening this Bikramjeet Singh with the danda he was holding towards head which I in order to save hit on left side below with him Kaptan Singh with the danda he was holding hit on my left leg near my knee then Deep son of not known resident of Mohabatpur hit with danda he was holding on my stomach, then these all three hit with dandas on my back, thigh, legs, arms and shoulders beaten me badly, then Bikramjeet Singh pull out Manpeet Kaur and Navdeep Kaur and got them sitted in his XUV car, then Kaptan Singh snatched my I phone 15 pro from me, Bikramjeet Singh took out forcibly RC,insurance documents and my car holders from dashboard of my car forcibly, In which my driving License, my PAN and Aadhar card, ATM card, Credit card also and in dash board kept around 21000-22000 that also even on my resistance took away, when Bikramjeet Singh and Kaptan Singh my mobile phone and cash and other documents they snatched keeping in there car.

CRM-M-40433-2025 (O&M) -3 Bhawanigarh, then they started following in there car then they encircled me near Bhawanigarh bus stand and again beaten me with dandas, broken window pass of my car and hit on my car, then there when I raised alarm public started gathering, these all with there weapons ran away and then I called my friend Kulvir Singh son of Najar Singh resident of Rampura who got me admitted in PHC Bhawanigarh from where I was referred to CH Sangrur, reason for our enemity is that Bikramjeet Singh and Kaptan Singh were having doubt that I have relation with there aunty Manpreet Kaur then only Bikramjeet Singh and Kaptan Singh son of Angrej Singh resident of Shankerpur, Deep son of not known resident of Mohabatpur on asking of Sahib Singh with common intention, unnecessarily beaten me take appropriate legal action against Bikramjeet Singh, Kaptan Singh, Sahib Singh.I got recorded by statement at CH Sangrur which is alright, Applicant sd/- Princepal Singh.”

Learned counsel for the petitioner contends that the FIR in the present case was got registered by the complainant by coining a false story. In fact, the parties knew each other and are distant relative also. Learned counsel further contends that as per the case of the prosecution, petitioner was carrying a danda and caused an injury with danda on the left knee of the complainant, however, the said injury has been declared to be simple in nature. He further contends that the allegations regarding snatching of mobile phone, RC, insurance, license etc. are false and have been made by the complainant, only to aggravate the offence. Even, the two injuries which have been declared to be grievous in nature, were on non-vital parts of the body and the petitioner is ready to join the investigation. 4. On the other hand learned State counsel assisted by learned counsel for the complainant have vehemently opposed the submissions made by learned HITESH 2025.08.11 12:14 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh
CRM-M-40433-2025 (O&M) -4 counsel for the petitioner on the ground that total 15 injuries were caused to the complainant and out of those, 15 injuries, 02 injuries on fingers have been declared to be grievous in nature. 5. I have heard learned counsel for the parties and perused the record carefully. 6. At this stage, only allegation against the present petitioner is that he was carrying a danda and gave blow with the same on the left knee of the complainant and the said injuries have been declared to be simple in nature. Even, the parties are distantly related to each other and the custodial interrogation of petitioner may not be required, keeping in view the facts and circumstances of the present case. 7. Thus, without commenting any further, the present petition is allowed and the petitioner is granted concession of anticipatory bail, subject to the conditions as provided under Sections 482 (2) of B.N.S.S. It will be open for the Investigating Officer to call the petitioner to join the investigation, if so required, by issuing a written notice in this regard and she shall abide by the conditions mentioned in Section 482 (2) of B.N.S.S.
