1. Heard learned counsel appearing on behalf of the parties.
2. The present application has been filed for quashing the order dated NIL, wherein cognizance was taken for the offences under sections 147, 148, 149 and 302 of the Indian Penal Code and Section 27 of the Arms Act, in Mufassil P.S. Case No. 288 of 2019 pending in the court of learned C.J.M., Begusarai.
3. Out of submission and perusal of record, it appears that the impugned order passed through printed
Patna High Court CR. MISC. No.79 of 2024(2) dt.16-01-2025 2/2 forms in a very mechanical manner, where even reason for taking cognizance not appears prima facie explained. It also appears from impugned order that the date of passing order is also not available.
4. Considering the aforesaid, the impugned
order is hereby quashed/set aside with a direction to the learned C.J.M., Begusarai to pass a fresh and reasoned
order within two weeks after communication of this order.
5. With aforesaid observations, the present quashing petition stands disposed of.
