M/S INDUS LAW FIRM 3 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI WRIT PETITION No.4071 OF 2019 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: “….issue a writ, order or direction, more particularly one in the nature of writ of mandamus, declaring the action of 3rd respondent in calling petitioners to police station very frequently without any cause or reason as arbitrary, illegal, malafied and contrary to law and consequently direct 3rd respondent, not to interfere with petitioners personal liberty and as well as civil disputes pending between 1st petitioner and 5th respondent, in respect of patta lands, and with all other consequential benefits and pass…” 2. Heard Sri K.Ananda Rao, learned counsel for the writ petitioners, the Station House Officer, Yerpedu Police Station, through video conference and learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader on instructions from the concerned Station House Officer would submit that police registered a case and counter vide Crime Nos.131 of 2018 and 132 of 2018 against the petitioners and unofficial respondents. After completion of investigation, charge sheet also laid in both cases, and both cases are pending before the learned Magistrate for trial. The Station House Officer, who is present through VC would undertake that police will not call the petitioners without following due procedure established by law, and they will not interfere in civil matter. 4. Considering the undertaking made by the Station House Officer, this Court is of the considered opinion that no further orders are 4 required in the writ petition, and it can be closed. The petitioners are liberty to file fresh application, if police violates the personal liberty, without following due procedure established by law. The presence of the Station House Officer, Yerpedu Police Station, is dispensed with. 5. Accordingly, the Writ Petition is closed. There shall be no order as to costs.
