[2025:RJ-JP:14450] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 2885/2025 Daan Singh Son Of Vikram Singh, Aged About 36 Years, R/o Nagla Khuteta, Police Station Deeg Sadar, Distt. Deeg (Bharatpur), Rajasthan At Present Tenant At House No. 39, Mahaveer Nagar, Police Station Bajaj Nagar, Distt. Jaipur, Rajasthan. (Accused Petitioner Presently Confined In Central Jail Jaipur). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Shivam Sharma Mr. Ishan Kasliwal For Respondent(s) : Mr. Gaurav Kumar Gupta, PP Mr. Nemichand, CI, SOG-IO HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 28/03/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 19/2018 registered at Police Station S.O.G. District ATS and SOG, for the offence under Section 420, 120(B) of IPC and Sections 43, 66 and 72 of IT Act. Learned counsel for the petitioner submits that the accused petitioner has falsely been implicated in this case. The offences alleged to have been committed by the petitioner are exclusively triable by Magistrate. It is contended that the accused-petitioner is in custody since 29.01.2025 and there are no criminal antecedents against the accused-petitioner, trial of the case will take considerable time. Similarly situated co-accused Anil Kumar, [2025:RJ-JP:14450] (2 of 3) [CRLMB-2885/2025] Omveer and Radheysham have already been enlarged on bail, therefore, considering the above facts the petitioner may be enlarged on bail. Per contra, learned Public Prosecutor opposes the grant of bail application and submitted the factual report. The same is taken on record. It is contended that the accused-petitioner was in connectivity with main accused Anil Kumar, who provided answer- keys to the candidates Radheyshyam and Omveer. The accused- petitioner has provided answer-keys to other co-accused Harendra Singh and the accused-petitioner was in contact with him, therefore considering the gravity of the offence, instant bail application of the accused-petitioner deserves to be dismissed. Heard and perused the material available on the record. It is not desirable to express anything on the merit of the case, accused-petitioner is in custody since 29.01.2025 and the charge-sheet against the accused-petitioner is going to be submitted before the concerned court. Other similarly situated co- accused have already been enlarged on bail. The offences alleged to have been committed by the petitioner are exclusively triable by Magistrate. The trial of the case will take considerable time, considering the above facts, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Daan Singh Son Of Vikram Singh, in connection with FIR No. 19/2018 registered at Police Station S.O.G. ATS and SOG, shall be enlarged on bail provided he furnishes a personal bond in the sum [2025:RJ-JP:14450] (3 of 3) [CRLMB-2885/2025] of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
