Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioner has, inter alia, prayed for the following relief:- “The petitioner, therefore, prays that this Hon'ble Court in exercise of its revisional, visitorial and supervisory jurisdiction may be pleased to send for the records of the case and after examining the legality and proprietary of the proceedings may be pleased to quash and set aside the order of the Additional District Judge, Dehra dated 28.02.2023 in Civil Miscellaneous Appeal No. 01/G/XIV/2023/2022 Vinod Singh Versus Lal Chand 1Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:33341 decided on 28.02.2023 whereby he affirmed the order dated 25.05.2022 dismissing the application under Order 39 Rule 4 C.P.C. for modifying and setting aside the exparte order dated 23.10.2019, Annexures P-1 and P-2. Such other orders which this Hon'ble Court may deems fit and proper in the facts and circumstances of the case, may also be passed in favour of the applicant.” 2. In light of the fact that status quo order passed by the learned Trial Court in the year 2019 is in force since then, this Court is of the considered view that as no interim was granted to the petitioner in the present proceedings, these proceedings have now lost their efficacy. 3. On a query put to the learned counsel for the parties, the Court stands informed that the case is at the stage of recording the evidence of the plaintiff. 4. Accordingly, without interfering with the orders impugned, this petition is disposed of with the observation that the learned Trial Court shall make an endeavour to decide the Civil Suit, as expeditiously as possible. Not more than three opportunities shall be granted to either of the parties to lead evidence. In case, the plaintiff has already been granted three 3 2025:HHC:33341 opportunities, then the learned Trial Court will only give one more opportunity to the plaintiff to lead evidence.
