JUSTICE M.NAGAPRASANNA) 1. The petitioner is before this Court seeking the following prayer. “A. Issue a writ of mandamus, directing respondent no.2/Gangavathi Town Police Station to not to destroy the goods seized by it as per Annexure-C, pending consideration of the petitioners application seeking release of goods filed by the petitioner in crime no.210/2023 on the file of the learned Principal Civil Judge of JMFC, Gangavathi vide Annexure-D. B. Issue a writ of mandamus, directing the learned Principal Civil Judge and JMFC, Gangavathi to provide the petitioner an opportunity of being heard before passing any orders on the requisition made by the 2nd respondent for destruction/disposal of goods so seized under Annexure-C in Crime No.210/2023 of Gangavathi Town Police Station. 2. The Co-ordinate Bench of this Court on 23.11.2023 had passed the following order. “Learned AGA accepts notice for respondents. Respondents are directed not to destroy the goods seized by it as per Annexure – C to the writ petition, till the next date of hearing.” 3. The learned counsel to the petitioner submits charge sheets have already been filed and the matter is seized off by the Co-ordinate Bench under Section 482 of Cr.P.C. / Section 528 of BNSS. - 3 - HC-KAR NC: 2025:KHC-D:17545 WP No. 106950 of 2023 4. In the light of the said circumstance, I deem it appropriate to dispose the petition, further making it subject to the result of the proceedings pending before the Co-ordinate Bench under Section 482 of Cr.P.C. It is open to the petitioner to seek appropriate orders at the hands of the said Court in the event of need. 5. With the aforesaid observations, the petition stands disposed.
