By the aforesaid order, the fair price shop license of the petitioner was cancelled. 2. A preliminary objections has been raised by the learned Standing Counsel appearing on behalf of State-Respondents that against aforesaid order, statutory alternative remedy is available to the petitioner to file an appeal before the Commissioner of Division (Food) as provided under Sub-Section 1 of Section 13 of the U.P. Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016. 3. In this view of the matter, the writ petition is dismissed on the ground of availability of statutory alternative remedy. 4. Certified copy of order which is appended along-with the petition, office is directed to return the same to the learned counsel for the petitioner, after keeping the photocopy of the same.
