For Petitioner(s): Mr.C.Prakasam https://www.mhc.tn.gov.in/judis CRP No. 3724 of 2025 ORDER This Civil Revision Petition is filed by the petitioner seeking a direction to the Subordinate Court, Kancheepuram to dispose of A.S.No.8 of 2024 within a stipulated time. 2. Pursuant to my order dated 13.08.2025, the learned Additional Subordinate Judge, Kancheepuram has forwarded a report to the Registry of this Court in D.NO.957/ 2025 dated 21.08.2025. 3. The appeal was filed on November 17, 2022, at the instance of the plaintiff, who was unsuccessful in a suit for permanent injunction. The sole respondent in the appeal, namely the defendant in the suit, has also passed away, and the appeal was originally filed along with a petition to condone the delay, which was condoned. The appeal was taken on file as early as February 29, 2024. The learned Subordinate Judge has indicated that the records have not been received from the Trial Court. Further, the sole respondent died on March 18, 2025. Mr.C.Prakasam, learned counsel for the petitioner, states that the defendant died as a bachelor, and the petitioners are not aware of the legal heirs. https://www.mhc.tn.gov.in/judis CRP No. 3724 of 2025 Therefore, they propose to cause publication after seeking permission from the First Appellate Court. 4. Be that as it may, the appeal is pending right from September 2024, I am inclined to allow the Civil Revision Petition and directs the learned Additional Sub Judge, Kancheepuram, to dispose the appeal on merits and in accordance with law after completing service of notice on the legal representatives of the deceased sole respondent on or before 31.12.2025. 5. Accordingly, this Civil Revision Petition is allowed.
