JUSTICE SANDEEP KUMAR ORAL ORDER 3 19-03-2025 Heard learned counsel for the petitioner and learned counsel for the Narcotics Control Bureau. 2. This is the second attempt on behalf of the petitioner for grant of regular bail in connection with NCB Case No.06 of 2023/ NDPS Case No.151 of 2023 registered for the offence under sections 18, 27-A, 29, 62 of the N.D.P.S. Act. 3. It is alleged that about 6 kgs. of afim has been recovered from the petitioner and other accused perrsons. Rs.4,05,000/- has also been recovered from the accused persons. 4. Learned counsel for the petitioner submits that in the trial out of nine witnesses only two witnesses have been examined by the N.C.B. though the petitioner is in custody since 23.02.2023. Though learned counsel for the N.C.B. has vehemently opposed the prayer for bail of the petitioner but considering the fact that there is no recovery of afim from the petitioner, his period of custody and also considering the delay in trial, this bail application is allowed. 6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.1,00,000/- (Rupees One Lakh Only) with two sureties of the like amount each to the satisfaction of the learned Special Judge, N.D.P.S.-II, Muzaffarpur/ concerned Court, in connection with NCB Case No.06 of 2023/ NDPS Case No.151 of 2023, subject to the condition that both the bailors should be the blood relatives of the petitioner. 7. This is also subject to the condition that the petitioner will cooperate in the trial and will appear either personally or through his lawyer on the dates fixed in the trial. Violation of the aforesaid conditions will result in cancellation of bail bonds of the petitioner. pawan/- (Sandeep Kumar, J) U T
