The present criminal writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus seeking issuance of directions to respondents No.2 and 3 to protect the life and personal liberty of the petitioner, who is alleged to be the complainant/prosecution witness in FIR No.141 dated 23.06.2022, under Sections 376 & 506 IPC, registered at Police Station City South Moga, District Moga.

Learned counsel for the petitioner contends that after availing an interim order of bail in his favour, respondent No.6 got registered a false FIR No.245 dated 25.11.2022, against the petitioner, under Sections 379-B, 323, 451, 427, 148, 149 & 506 read with Section 120-B IPC at Police Station City South, Moga. However, during investigation, it was found that the said FIR was got registered at the instance of respondent No.6 as a ploy Ramandeep Singh 2025.05.09 13:42 I attest to the accuracy and integrity of this document

for the purpose of threatening and harassing the petitioner and coercing her to enter into a settlement with him.

Learned State counsel while placing reliance upon status report dated 18/22.03.2025 submits that after completion of investigation, challan against respondent No.6 has been presented before the Court on 16.08.2022 and charges against him were framed on 27.02.2023. Chief examination of the victim-petitioner has been completed on 08.10.2024. Moreover, during trial, the petitioner has not moved any complaint before the learned trial Court as well as answering respondents, regarding the alleged harassment or any threat to her life and liberty. He further submits that the permanent guard has already been deployed at all the entry gates of the District Court Complex. The answering respondents are doing their duty honestly, fairly and without any pressure.

In view of above submissions, no further orders are required to be passed in the matter and the present petition is dismissed as rendered infructuous.
