…Respondents
CORAM : HON’BLE MR. JUSTICE VIKRAM AGGARWAL Present: Mr. Vipin Mahajan, Advocate, for the applicants-appellants.
Mr. Vishal Munjal, Advocate, for respondents No.3, 6 and 7.
*** VIKRAM AGGARWAL, J (ORAL)
This is an application preferred by the applicants-appellants under Order 23 Rule 1 and 3 CPC for withdrawal of the instant appeal.
2.
Learned counsel for the applicants-appellants, on instructions from appellant No.2 (Satnam Singh), who is present in Court, submits that the applicants-appellants do not wish to pursue the present appeal and that they may be permitted to withdraw the same. It would be relevant to mention here that though a compromise deed has been placed on record, learned counsel for the applicants-appellants has specifically submitted that he may simply be permitted to withdraw the appeal without any reference to the said compromise deed.
3.
Respondents No.3 and 6 (Kulbir Singh and Dalbir Singh) are also present. Appellant No.2 and respondents No.3 and 6 have been identified by their counsel and photocopies of Aadhar Cards have been furnished which are retained on record.
4.
For the reasons mentioned in the application, which is duly supported by an affidavit of Satnam Singh and keeping in view the statement VIKAS CHANDER 2025.04.04 15.01 I attest to the accuracy and integrity of this document
RSA-2527-2013 (O&M) -2-
given by learned counsel for the appellants, the present application is allowed and the present appeal is dismissed as having been withdrawn.
Pending application(s), if any, shall also stand disposed of.
