This writ petition has been filed with the following prayers:- "(A) To issue a writ, order or direction in the nature of mandamus directing the respondents to exempt the pond, Gata no 723 Gh, area 0.5060 hectare, Gramshabha Birhar Tehsil Narval District Kanpur Nagar from the auction fixed 7,8,2025. (B) To issue writ order or direction in the nature of Mandamus directing the respondents, not to disposes the petitioner from pond gata no 723 Gh, area 0.5060 hectare Gram Birhar Tehsil Narval District Kanpur Nagar during the pendency of the writ petition." Learned counsel appearing for the Gaon Sabha has vehemently opposed the writ petition on the ground that after the decision of Apex Court rendered in case of Hinch Lal Tiwari vs. Kamala Devi and Ors, 2001 (6) SCC 496, no land of pond can be settled with petitioner. No case for interference is made out. The writ petition is misconceived and stands dismissed.
