This is a 2nd petition under Section 528 of BNSS, 2023 seeking quashing of the order dated 16.03.2006 (Annexure P-3) in case FIR No.132 dated 21.06.2005 under Sections 307, 342, 506, 148, 149 IPC (Section 307 IPC deleted later on in challan) and Sections 3, 4 of the SC/ST Act (Annexure P-1) at P.S. Shahkot, District Jalandhar vide which the petitioner was declared proclaimed offender. 2. Learned counsel for the petitioner submits that the petitioner had no intention to evade the legal proceedings and has never deliberately avoided the process of law. He submits that as the misunderstanding between the parties was settled and on the assurance of complainant/respondent No.2 that the presence of the petitioner would not be required, the petitioner went abroad on 07.10.2005. Learned State counsel vehemently opposed the prayer and submitted that the petitioner deliberately avoided the process of law and does not deserve any relief from this Court. 4. At this stage, the learned counsel for the petitioner submits that the petitioner is ready to surrender before the learned Trial Court/Illaqa Magistrate within 04 weeks from today and his only prayer is that upon surrender his regular bail application be decided expeditiously. 5. The petition is disposed of. 6. In case the petitioner surrenders within 04 weeks from today before the learned Trial Court/Illaqa Magistrate and applies for regular bail, the court concerned shall take up the bail application and decide it as expeditiously as possible. In case the petitioner fails to surrender within 04 weeks, this order shall stand vacated automatically without reference to this Court.
