ORDER: This Criminal Petition, u/See.480 & 483 of the Bharatiya Nagarik suraksha sanhita, 2023, has been filed by the petitioner/A4, seeking bail, in cr|lme No.46/2025 of Bheemunipatnam Police Station, Visakhapatnam Commissionerate. 2. A case has been registered aga'lnSt the Petitioner and Others for the offence punishable u/See.310(2) of B.N.S.
3. Heard learned counsel for the Petitioner/A4 and the leamed Assistant public prosecutor representing the respondenVState. 4. Case of the prosecution, in brief, iS that, the defaCtO COmPlainant iS a resident of pedda sariyapall'l, srikakulam District. On 18.01.2025 in the afternoon hours, he received a phone call and he disconnected the same. Again on 19.01.2025 in the moming hours While he Was retuming from +- `\-3 a---
2 Narayana school, he receiV-ed phone call from the same number and from the same unknown lady/A7 who informed that she is very known to him and enquired his details. She asked him to come to Mudugullu area as she was coming to meet him and that he came to ANITS college junction. When he was waiting there, Al to A6 approached him and informed that he kidnapped one lady and took him away from there. A4 and A5 took the defacto complainant on a scooty and took him to Raghu engineering college. Al to A3 followed them on scooty and A6 followed on another scooty. Al to A6 took the defacto complainant to an isolated place on the left side of Fortune hills lay out, near Raghu engineering college. Then A3 and A6 caught hold of the defacto complainant rightly and detained there, whereas Al to A6 threatened and beat him. Further Al fisted on his face and robbed his phone and threatened him to disclose his phonepe password. They took cash of Rs.40,000/-from phonepe app. Thereafter Al to A6 threatened the defacto complainant with dire consequences not to disclose the said incident to anyone and left him. Al to A7 hatched a plan and bring the defacto complainant to the isolate place and robbed the money. Basing on the complaint of the defacto comp'ainant, the above said crime was registered and investigated into. During the course of investigation, the petit'loner was remanded to judicial custody on
24.01.2025. 5. Heard. Perused the record. 3 Learned Assistant Public Prosecutor submits that investigation in this case was completed charge sheet was also f'lled before the Court concerned.
The petitioner has nO antecedents and Submitted that the Court may pass appropriate orders. 7. After careful observation Of the material On record and SubmiSSiOnS made on behalf of both sides, it shows that the pet'ltioner has been in judicial custody from 24.01.2025 and investigation iS completed, charge sheet was also filed and as stated by the learned Assistant Public Prosecutor that he petitioner has no antecedents. This Court found that further detention of the petitioner is not required as charge sheet is filed. Since the accused has been in remand from 24.01.2025, this Court found that most of the investigation pertaining to the role played by the petitioner in the commission of the offence would be completed. lt is submitted that the petitioner has permanent abode and there is no possibility of his fleeing away from justice. considering the entire material on record, this Court is inclined to grant bail to the petitioner with some conditions. 8. ln the result, the Criminal Petition is allowed with the following conditions: (i) The petitioner/A4 herein shall be released on his executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the learned XV Additional Metropolitan Magistrate at Bheemunipatnam; I i-
