ORAL ORDER

The revision petitioner and the respondent are present along with their counsels and they are duly identified by their counsels. They submit that in the mediation, they have settled the dispute and accordingly, they filed the memorandum of agreement under Section 89 of the C.P.C. They submit that the petitioner/accused agreed to pay the sum of ₹7,00,000/- to the respondent towards full and final settlement of the claim in respect of the cheque involved in the matter. It is submitted that a sum of ₹1,40,000/- has already been paid by way of deposit before the Trial Court. It is further stated that thereafter a further sum of ₹2,10,000/- has been deposited before the First Appellate Court. It is further submitted that the remaining sum of ₹3,50,000/- has been paid by the petitioner to the respondent through demand draft bearing No.910159 dated 05.11.2025 drawn on SBI, Dharwad. The respondent acknowledges the receipt of the said demand draft. Therefore, the parties submit

that the matter may be compounded and the revision be
disposed of itself. Having ascertained the above transaction between the parties and they having acknowledged the same, the agreement reached before the Mediation Center is accepted. Hence, the following:
ORDER i) The impugned judgment passed by the Trial Court as well as the First Appellate Court are hereby set aside. ii) The accused/petitioner stands acquitted in terms of Section 147 of the Negotiable Instruments, Act and the case stands compounded. iii) No further proceedings are required. iv) The amount which has been deposited before the Trial Court and the First Appellate Court is permitted to be withdrawn by the respondent/complainant.
