Applicant Shahrukh, who is in judicial custody in Case Crime/ FIR No.1148 of 2023, under Section 307 of IPC and Section 25(1B) (B) of Arms Act, registered at Police Station Kotwali, Manglore District Haridwar, has sought his release on bail. 2. Heard learned counsel for the parties and perused the material available on record. 3. Learned counsel for the applicant would submit that the applicant is innocent and has been falsely implicated in the instant crime; that, the applicant has no previous criminal history. 1 2025:UHC:2070 4. Learned counsel for the applicant would further submit that the complainant and injured have been examined in the trial court as PW1 and PW2, both of them have been turned hostile in the trial court and no purpose would be served by keeping the applicant behind bars as there are bleak chances of conviction of the applicant in the present case. 5. Learned counsel for the State vehemently opposed the bail application. 6. In view of the above, without expressing any opinion about merits of the case before the Trial Court, this Court is of the view that this is a fit case for bail. 7. The bail application is thus, allowed and the applicant is directed to be released on bail on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
