S. No. 13 Regular Cause List IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR
SWP No. 1210/2018 Mohammad Syed Reshi …Appellant/Petitioner(s) Through: Mr. Arif Javid Khan, Advocate Vs. Chairman Ellaquai Dehati Bank and Anr. ...Respondent(s) Through: Mr. Shakir Haqani, Advocate CORAM:
HON’BLE MR JUSTICE VINOD CHATTERJI KOUL, JUDGE
O R D E R 03.07.2025 The main ground on which this petition has been filed by petitioner is that he filed an appeal against order of dismissal which was not decided within the period of six months. Perusal of the Reply, filed by the respondents way back in the month of August 2018, would reveal that respondents have specifically stated in Para 3 that the petitioner without waiting for the disposal of appeal filed writ petition and that the said appeal has already been decided and rejected. Copy of the order has been produced by the respondents today. It is evident from the reply that the appeal filed by petitioner has been decided way back in the year 2018, but learned counsel for the petitioner has not chosen to challenge the said order more particularly when instant petition has been filed on a plea that appeal made by petitioner has not been decided, which contention of petitioner is wrong and therefore, this petition would not serve to be on board and is accordingly dismissed. However, it shall be open for the petitioner to take recourse to the remedy as may be available to him under law.
