GP FOR CIVIL SUPPLIES The Court made the following ORDER: The present Writ Petition is filed questioning the endorsement dated 29.11.2024 in Rc.S.G.232/2024 of 3rd respondent by cancelling the fair price shop dealership held by the petitioner at Mudivarti Village of Vidavalur Mandal, SPSR Nellore District without there being any valid reason, and withoutthere being any valid reason and without following any procedure under law as illegal, arbitrary and violative of Articles 14, 19(1)(g) of the Constitution of India and also violative of A.P. Public Distribution System (Control) Order, 2008 and principles of natural justice and set aside the same 2 and direct the respondent Nos.3 and 4 to continue the petitioner to hold fair price shop dealership for Shop No.23 of Mudivarthi Village, Vidavalur Mandal, SPSR Nellore District. 2. During the course of hearing, the learned counsel for the petitioner submitted that the appeal filed before the Joint Collector is pending, and requested that the Joint Collector may be directed to pass orders on the same. 3. In view of the submission made by the learned counsel for the petitioner, without going into the merits of the case, the Writ Petition is disposed of directing the Joint Collector to dispose of the appeal preferred by the petitioner, within a period of one (1) month from the date of receipt of a copy of this order, failing which, the respondents shall renew the authorization of the petitioner’s fair price shop. No order as to costs.
