JUSTICE S G PANDIT) The petitioner before the learned single judge is in appeal under Section 4 of the Karnataka High Court Act, 1961, questioning the rejection of writ petition filed under Article 226 of the Constitution of India, in Writ Petition No.103463/2024, whereunder, petitioner's prayer for a Mandamus directing the respondents to consider his representation is rejected. 2. Heard learned counsel Sri.B.S.Sangati for appellant and learned counsel Sri.S.A.Sandur for respondent No.1 and learned AGA Sri.Sharad V. Magadum for respondent No.2. 3. The petitioner is before this Court praying for a Writ of Mandamus to consider representations whereunder he had prayed for settlement of payment for the work carried out entrusted to it by the first respondent. 4. Learned single Judge on scrutiny of the material on record, recorded a finding that the petitioner alleges non- payment and the first respondent contends that the payment has been made and controversy regarding the payment and - 4 - HC-KAR NC: 2025:KHC-D:18081-DB WA No. 100318 of 2025 non-payment cannot be considered in the writ petition because it involves disputed questions of fact. The said finding, in facts and circumstances, is proper and justified. Moreover, learned counsel for respondent No.1 Sri.S.A.Sandur has filed a memo dated 12.12.2025 enclosing certain documents to indicate that payment along with interest has been made during the year 2021 itself. 5.
