Learned counsel for the petitioner seeks permission to withdraw this interlocutory application. Prayer is allowed. Accordingly, this interlocutory application is dismissed as withdrawn. B.A. No. 2271 of 2025 Heard the parties.
The petitioner has been made accused in connection with S.T. No.246 of 2021 arising out of Rajmahal P.S. Case No. 173 of 2021, for the offences registered under Sections 147/149/341/342/323/302/427/504/506 of the I.P.C., pending in the Court of learned Additional Sessions Judge-I, Rajmahal.
Bail application of the petitioner was earlier rejected by a Co- ordinate Bench of this Court vide B.A. No.14182 of 2021 by order dated
11.01.2022.
On 31.07.2021, petitioner along with co-accused persons are alleged to have assaulted the husband of the informant due to which he succumbed to his injuries. There is general allegation against 8 named persons and 10- 15 unknown persons.
Learned counsel for the petitioner submitted that for the same occurrence, there is case and counter case between the parties. It was further submitted that in inebriated condition one person fell from motorcycle and died. The members of his community started protesting against his death due to which this occurrence has taken place.

Considering the fact that there is general and omnibus allegation against the petitioner, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-I, Rajmahal, in connection with S.T. No.246 of 2021 arising out of Rajmahal P.S. Case No. 173 of 2021.
