JUSTICE K V ARAVIND - 3 - HC-KAR NC: 2025:KHC-D:8788-DB CCC No. 100240 of 2025 ORAL ORDER (PER: THE HON'BLE MR. JUSTICE R.DEVDAS) Learned AGA has drawn the attention of this court to paragraph 9 of the contempt petition where it is stated by the petitioners that subsequent to the directions issued by the learned Single Judge on 19.06.2024, an endorsement has been issued by respondent No.2-Chief Executive Officer, Zilla Panchayat, Koppal rejecting the request made by the petitioners for regularization of their services. It is also pointed out that the petitioners have already filed writ petition in W.P.No.100406/2025 raising a challenge to the endorsement dated 12.08.2024 issued by respondent No.2. 2. Learned counsel for the petitioners however seeks to contend that despite the specific directions being given by the learned Single Judge, that “respondent No.4 shall not cause any further delay in the matter on the pretext of he not having power in view of specific direction already issued by the Chief Engineer, Panchayat Raj, - 4 - HC-KAR NC: 2025:KHC-D:8788-DB CCC No. 100240 of 2025 Engineering Department, and that respondent No.4 shall give effect to the orders within a period of eight weeks without any further delay”, such endorsement is again issued by respondent No.2. 3. We have heard the learned counsel for the petitioners and learned AGA. 4. We find from the directions issued by the learned Single Judge that there is no positive direction that respondents have to pass an order for regularization. It is a direction to consider the case of the petitioners for regularization as was done in respect of the persons who were similarly situated. If by issuing endorsement subsequently, respondent No.2 is of the opinion that the petitioners are not similarly situated and therefore, they cannot be regularized in the service, the petitioners have rightly filed the writ petition raising a challenge to the endorsement. - 5 - HC-KAR NC: 2025:KHC-D:8788-DB CCC No. 100240 of 2025 5. In that view of the matter, the contempt petition will not survive for consideration. Accordingly, the contempt petition stands disposed of. 6. Learned counsel Sri.Vijaykumar Balagerimath has entered appearance for respondent No.2 and is permitted to file vakalath for respondent No.2 within eight weeks. 7.
