JUSTICE M.NAGAPRASANNA) 1. The petitioner is before this Court seeking the following prayer: a. issue a writ of mandamus directing the respondents to consider the representations dated 30.12.2024 given by the petitioner society vide Annexure-L and M and provide police protection to avoid any breach of peace. b. Issue any other writ, order or direction to which the petitioner society is found entitled to in the present facts and circumstances. 2. The petitioner institutes a suit in O.S.No.1108 of 2009 and secures an order of injunction. The defendants therein appear to have challenged the same before the First Appellate Court in R.A.No.25 of 2019 which also comes to be dismissed. Another suit in O.S.No.12 of 2019 is filed by the petitioner against the same defendants who had suffered an order. The said suit is also decreed on 10.11.2022. In those circumstances, the petitioner submits a representation to the jurisdictional police seeking police protection, on the score that the defendants are interfering with the property of the petitioner. The police not having considered the same, the petitioner is before this Court. - 3 - HC-KAR NC: 2025:KHC-D:17510 WP No. 102472 of 2025 3. The State has issued a Circular on 14.11.2018. Clause 10 thereof depicts that any person who on the strength of an order of the Civil Court seeks police protection, the State shall so accord after analysing the situation. 4. In that light, I deem it appropriate to dispose the subject petition directing the State to consider the representation of this petitioner and pass necessary orders bearing in mind the Circular dated 14.11.2018 and analyse the threat real time to the possession of the petitioner and accord such police protection.
