Heard Sri Sudhir Kumar Shukla, learned counsel for the petitioners. 2. The instant petition has been filed for the following reliefs:- "It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to pass an order, direct the Civil Judge (Senior Division) Prescribed Authority Kanpur Nagar to decide the Rent Case No. 40 of 2008 (Smt. Shanti Devi Versus Raghubir Saini) under Section 21 (1) (a) U.P. Rent Central Act No. 13 of 1972 within stipulated period, and/or pass such other and further order which this Hon'ble Court may deem fit and proper under the circumstances of the case otherwise the petitioners shall suffer an irreparable loss and injury." 3. Learned counsel for petitioners submitted that proceeding of Section 21 (1)(a)of U.P. Act 13 of 1972 at the instance of petitioners is pending before the Civil Judge (Senior Division)/Prescribed Authority, Kanpur Nagar since 2008. He placed the certified copy of the order sheet of pending proceeding in order to demonstrate that matter is not proceeding expeditiously. 4. Considering the facts and circumstances of the case, the petition is disposed of directing the Civil Judge (Senior Division)/Prescribed authority, Kanpur Nagar to decide the Rent Case No. 40 of 2008 (Smt. Shanti Devi Versus Raghubir Saini) under Section 21 (1)(a) of the U.P. Act 13 of 1972 expeditiously within a period of two months from the production of a certified copy of this order after affording opportunity of hearing to both the parties.
