Neutral Citation No. - 2025:AHC:135660 Court No. - 9 Case :- MATTERS UNDER ARTICLE 227 No. - 8809 of 2025 Petitioner :- Ghanshyam Das Thapak Respondent :- Nemi Chandra Jain And 2 Others Counsel for Petitioner :- Abhishek Tiwari Hon'ble Manish Kumar Nigam,J. 1. Heard learned counsel for the petitioner and perused the record. 2. This petition has been filed for the following relief: "(i) To set-aside the impugned judgment/ order dated 15.05.2025 passed by the Civil Judge (Jr. Div.), Mauranipur, Jhansi, in Original Suit No. 164 of 2017 (Ghanshyam Das Thapak Vs. Nemi Chandra Jain and others)." 3. Earlier the respondent has approached this Court by means of Matters Under Article 227 No. 4130 of 2024 wherein an order dated 03.04.2024 has been passed by this Court. This court granted injunction in favour of the defendant and also directed the trial court to ensure compliance of the injunction order granted by this Court. On an application moved by the defendant, an order has been passed by the trial court for the compliance of the order. 4. In my view, second writ petition is not maintainable against the order. The petitioner may raise his grievances, if any, by moving an application in the pending proceedings. 5. With these observations, the petition is disposed of. Order Date :- 11.8.2025 Nitika Sri. (Manish Kumar Nigam,J.) Digitally signed by :- NITIKA SRIVASTAVA High Court of Judicature at Allahabad
