THIS WRIT PETITION, COMING ON FOR PRELIMINARYB HEARING IN ‘B’ GROUP THIS DAY, ORDER WAS MADE THEREIN AS UNDER: ORAL ORDER (PER: THE HON'BLE MR. JUSTICE M.NAGAPRASANNA) 1. The petitioner is before this Court seeking the following prayer: I. Issue a Writ of mandamus, directing the Respondent No.2 and respondent no.3 to consider the representation submitted by the petitioner as pr Annexure-F dated 9.6.25 and to declare and publish the final selection list dated 27-05-2025 for the post of Anganwadi Helper in respect of ward no.7, Maruti Nagar-2, Dandeli Village vide at Annexure-E and revoke the final list by mentioning the petitioner name in the interest of justice and equity. II. Issue such other Writ/Order/direction as deemed fit under the facts and circumstances of the case, in the interest of justice. 2. The petitioner is a participant in the selection process to the post of Anganwadi Helper. - 3 - HC-KAR NC: 2025:KHC-D:14595 WP No. 104081 of 2025 3. The learned HCGP would on instructions, submit that the provisional select list, wherein the name of the petitioner did figure, has been objected to by one Soumya, who is said to be a widow. The matter is at that stage. Therefore, the petition so preferred by the petitioner is undoubtedly premature. 4. The learned counsel for the petitioner submits that the objections of Soumya had been rejected and what remains is issuance of a final select list. While this Court, cannot issue a mandamus to issue the final select list at the apprehension of a participant for inclusion in a select list of reserved participant to notify the selectors. 5. The learned HCGP on instructions and verification of the records would now submit that the said selection process itself is shelved and a new notification is issued calling for applications from eligible candidates. Therefore it is for the petitioner to apply under the new notification calling for applications for the post of Anganwadi Helper. The name of the petitioner is only found in the provisional select list. 6. It is trite that a candidate whose name figures in the provisional select list would not get any right to question the selection or seek a mandamus that the selection should be taken - 4 - HC-KAR NC: 2025:KHC-D:14595 WP No. 104081 of 2025 to its logical conclusion. Therefore, reserving the liberty to the petitioner to knock at the doors of the appropriate fora at the event of need and also reserving liberty to participate in the selection process. Pursuant to the subsequent notification, the petition stands dismissed. 7. In the event, the apprehension of the petitioner is correct that the recruitment process in so far as the present ward is shelved only to accommodate Soumya Hadapad, the petitioner is at liberty to move the matter for revival of the subject matter.
