(Oral) It is the case of the petitioners that they are residents of village Budhlakot, Post Office Pangot, Tehsil Kainchi Dham, District Nainital, however, their names are not included in the voter list of the said village. 2. Heard learned counsel for the parties and perused the record. 3. Learned counsel for the petitioners would submit that the petitioners are residents of village Budhlakot, Post Office Pangot, Tehsil Kainchi Dham, District Nainital; their names are not included in the voter list of said village; they have already submitted applications in Form-2 to the respondent no. 2/Sub Divisional Magistrate, Kainchi Dham; but, till date, no decision has been taken on the applications of the petitioners for inclusion of their names in the voter list. Learned counsel would submit that directions may be issued to the respondent no. 2/Sub Divisional Magistrate, Kainchi Dham to take a decision on the applications of 2 the petitioners before the last date of nomination, so that they may exercise their right to vote. 4. Learned State Counsel gives a statement that the respondent no. 2/Sub Divisional Magistrate, Kainchi Dham will take a decision on the applications of the petitioners before the last date of nomination. 5. The Court takes on record the statement given by the learned State Counsel. 6. The writ petition is disposed of with the directions to the respondent no. 2/Sub Divisional Magistrate, Kainchi Dham to take a decision on the application of the petitioners for inclusion of their names in the voter list before the last date of nomination. 7. The Court requests the learned State Counsel to communicate this order to the respondent no. 2/Sub Divisional Magistrate, Kainchi Dham. 8.
